By accessing or using our website, purchasing products, or engaging with our services, you agree to be bound by these TOS. If you do not agree with any part of these terms, you should not use our services.

General Terms
1.1. Account Creation: In order to access certain features or place orders on our website, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

1.2. Prohibited Conduct: You agree not to engage in any activity that may:

  • Violate any applicable laws, regulations, or third-party rights.
  • Interfere with or disrupt the operation of our services.
  • Engage in any fraudulent, abusive, or malicious behavior.

Product Listings and Orders
2.1. Product Information: We strive to provide accurate and up-to-date information regarding our products. However, we do not guarantee the accuracy, completeness, or reliability of any product descriptions, images, or other content.

2.2. Pricing and Payments: All prices displayed on our website are in based on geolocation (CAD/USD) and does not include applicable taxes or shipping fees, unless otherwise stated. We reserve the right to change prices at any time without prior notice. Payments are processed securely through our designated payment gateway. By placing an order, you authorize us to charge the provided payment method for the total order amount.

2.3. Order Acceptance and Cancellation: We reserve the right to accept or decline any order at our discretion. In the event we decline your order, we will provide a full refund. If a cancelation is requested, it will be subject to a 10% restocking fee.

2.4. Shipping and Delivery: We will make reasonable efforts to fulfill orders promptly and provide estimated delivery times. However, we are not responsible for any delays or damages caused by shipping carriers or unforeseen circumstances beyond our control.

Intellectual Property
3.1. Ownership: All content, including but not limited to logos, trademarks, product images, and website design, are the property of HPW Cards Inc. or its licensors. You may not use, reproduce, modify, or distribute any content without obtaining explicit permission.

3.2. User-Generated Content: If you submit any user-generated content to our website or social media channels, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, reproduce, and distribute that content for promotional and marketing purposes.

Limitation of Liability
4.1. Disclaimer: We strive to provide accurate information and quality products, but we make no warranties or representations regarding the completeness, accuracy, reliability, or suitability of our services or products for any purpose. We shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use or inability to use our services or products.

4.2. Indemnification: You agree to indemnify and hold HPW Cards Inc, its officers, directors, employees, and affiliates harmless from any claims, damages, losses, liabilities, costs, or expenses arising out of your breach of these TOS or your violation of any law or the rights of a third party.

Amendments and Termination
5.1. Amendments: We reserve the right to modify, suspend, or terminate any part of our services or these TOS at any time without prior notice. It is your responsibility to review these TOS periodically for any changes.

5.2. Termination: We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these TOS.

Governing Law and Dispute Resolution
6.1. Governing Law: These TOS shall be governed by and construed in accordance with the laws of Alberta, without regard to its conflict of laws provisions.

6.2. Dispute Resolution: Any dispute arising out of or relating to these TOS or the use of our services shall be resolved through negotiation or mediation. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in accordance with the rules of Arbitration Company that is named if dispute arises.

6.3. Loyalty and VIP program: We reserve the rights to modify, suspend, or terminate any part of this program without prior notice or liability, for any reason.
